Terms of service
General Terms and Conditions (GTC)
1. Scope and Seller Information
These General Terms and Conditions apply to all orders placed through the online shop of Anne Schlesinger.
The seller and contractual partner is:
Anne Hanna Schlesinger
c/o IP-Management #10422
Ludwig-Erhard-Straße 18
20459 Hamburg
Germany
Email: kontakt@anne-schlesinger.com
These Terms and Conditions apply to both consumers and business customers, unless otherwise agreed.
2. Artworks Offered
The online shop offers completed, hand-painted original artworks. Each artwork is a unique, individual piece.
Every effort is made to present the artworks as accurately as possible. However, colours and subtle nuances may vary slightly depending on individual screen settings.
Custom commissions and mural paintings are not part of the regular online shop offering. Separate agreements may be arranged for these services.
3. Conclusion of Contract
The presentation of artworks in the online shop does not constitute a legally binding offer but rather an invitation to place an order.
By clicking the final order button at checkout, customers submit a binding offer to purchase the items contained in their shopping cart.
A purchase contract is concluded when the seller accepts this offer. Acceptance may take place, in particular, through an order confirmation sent by email.
4. Prices and Payment
All prices displayed in the online shop are final prices and include the applicable statutory value-added tax (VAT), where applicable.
Any additional shipping costs are displayed during checkout before the order is completed.
Deliveries to countries outside the European Union may be subject to additional customs duties, import taxes or handling fees. Unless expressly stated otherwise, these charges are the responsibility of the recipient.
The available payment methods are displayed during checkout. Payments are processed through the respective selected payment service providers.
5. Shipping and Delivery
Orders are delivered to the shipping address provided during checkout, within the destinations offered by the online shop.
Information about shipping costs, shipping methods and estimated delivery times is available in the Shipping Policy and during checkout.
All artworks are carefully and securely packaged, using environmentally conscious and resource-saving materials wherever possible.
In the case of sales to consumers, the risk of accidental loss or damage to the goods generally passes to the customer only when the goods are handed over to the customer or another person authorised to receive them. Statutory exceptions remain unaffected.
6. Retention of Title
The artwork remains the property of the seller until full payment has been received.
7. Right of Withdrawal
Consumers generally have a statutory right of withdrawal when entering into distance selling contracts.
Detailed information about exercising this right, the applicable deadlines and the consequences of withdrawal can be found in the separate Right of Withdrawal Policy, including the model withdrawal form.
8. Statutory Rights Regarding Defective Goods
The statutory rights relating to defective goods apply.
All artworks offered are hand-painted originals. Artistic characteristics and any distinctive features expressly described in the product listing form part of the individual character of the artwork.
Customers' statutory rights in the event of defective goods remain fully unaffected.
9. Copyright and Usage Rights
The artworks offered in the online shop are protected by copyright. Copyright remains with the artist unless otherwise provided by law.
Purchasing an original artwork transfers ownership of the physical artwork only. It does not transfer any copyright or intellectual property usage rights, particularly rights relating to commercial reproduction, distribution or other forms of exploitation.
Uses permitted by law remain unaffected.
10. Contract Language and Contract Information
The contract language depends on the language selected during checkout. Orders may be placed in German or English.
Order information is processed and retained as part of the order fulfilment process. Following an order, customers receive an email confirmation containing the essential order details.
11. Applicable Law
German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers who habitually reside in another country, mandatory consumer protection provisions of that country remain applicable where required by law.
12. Consumer Dispute Resolution
The seller is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
